📋 2. Statutory Requirements for a Valid Takedown Notice

To ensure expeditious action, notifications of claimed infringement must include:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed (e.g., textbook title, edition, ISBN, or specific assessment source).
  • Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material (the direct URL of the deck or step).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

⚡ 3. Automated Repeat Infringer Policy (3-Strike Rule)

Pursuant to Section 512(i)(1)(A) of the DMCA, Vidyoric strictly maintains and enforces an automated three-strike policy for registered accounts:

Strike 1: Warning

Content quarantined immediately; creator must review copyright warranty standards.

Strike 2: Probation

30-day publishing freeze and monetization payout hold; manual approval on deck updates.

Strike 3: Termination

Permanent account termination, permanent delisting of all published content, and forfeiture of infringing proceeds.

🔄 4. Counter-Notification & Content Restoration

If a content creator believes that their deck was removed or disabled by mistake or misidentification (including claims of educational fair use or authorized licensing), the creator may file a statutory Counter-Notification pursuant to 17 U.S.C. § 512(g)(3).

Upon receipt of a valid counter-notice, we provide a copy to the original complaining party informing them that the material will be restored within 10 to 14 business days unless the copyright owner files an action seeking a court order restraining the creator from engaging in infringing activity.
